UB Law Professors Dolin and Hubbard have each submitted amicus briefs to the US Supreme Court in Federal Trade Commission v. Actavis, but the Court can only rule in favor of one.

ISSUE: Whether reverse-payment agreements are per se lawful unless the underlying patent litigation was a sham or the patent was obtained by fraud (Dolin), or instead are presumptively anticompetitive and unlawful (Hubbard).
